Terms of Service

These terms and conditions (“Terms”, “Agreement”) are an agreement between Prism Host (“Prism”, “company”, “us”, “we” or “our”) and you (“user”, “client”, “customer”, “you”, or “your”). This Agreement sets forth the general terms and conditions of your use of the prism-host.com website, other sites we own and operate, and any of its products or services (collectively, “Website”, “Products”, or “Services”).

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or in the plural.

Accuracy of Information

Occasionally there may be information on our services that contains typographic errors, inaccuracies or omissions that may relate to our promotions and/or services. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or terminate and/or suspend orders related to the errors, inaccuracies, or omissions. We are not reliable nor obligated to update, amend, or clarify information on the website or our services including, but not limited to, pricing information, except as required by law.

Account Registration

If you create any account on our services, you are solely responsible for maintaining the security of the account you made and you are held responsible for any and all activities that occur on your account. You must be at least 18 years old or older to order any of our services. If you are below 18 but 13 years old or older you may order our services with explicit permission from a legal guardian. You agree to not bypass any features we have in place. Providing any false information during the creation of your account or after the creation of your account may result in the termination of your account and your services. If you notice any unauthorized use of your account, you must notify us immediately, if Prism Host is not notified of any unauthorized use of your account your account and your services may be subject to termination.

Payments & Refunds

Upon purchasing a service from us, you will be required to pay the full amount of the order before your service will be activated unless stated otherwise. For an order to be eligible for a refund, you must meet the following criteria:

  • Your service must have been ordered and activated within a twenty-four (24) hour time period.
  • Your service must have been ordered and activated not more then twenty-four (24) hours before the refund request was filled.
  • You have a legitimate reason to request a refund.
  • Your service was not paid using a discount that takes more then 10% off the original price of the service. Service addons or additions not included.
  • Your service is not an upgrade or downgrade.
  • Your service is not a dedicated or value server.
  • Your service is not an addition to another service.
  • You are a newly registered customer.
  • Your service is not terminated and/or suspended.
  • Your service was not paid in partial or in full using account credit.
If your refund request does not meet the criteria stated above, it will be disregarded. Account credit is non-refundable. We reserve the right to disregard any refund request for any reason or without reason. Services are terminated 7 days after the renewal invoice is due. Sales tax may be applied to your order depending on where you reside.

Use Case

Clients are responsible for complying with all policies. Failure to do so will result in suspension and or termination of your account and its services. By using our services, you agree to abstain from the following, but not limited to, actions:

  • Denial of Service Attacks (DoS) & Distributed Denial of Service (DDoS) Attacks
  • Any sort of pornography or pornographical content.
  • Malware, ransomware or any other malicious code.
  • Using or distributing pirated software.
  • Identify Theft.
  • Spamming or “botting”.
  • IP Spoofing.
  • Cyberbullying, harassment, our encouraging self-harm.
  • Phishing or any other malicious intent.
  • Bypassing usage limits such as bandwidth, RAM limits, CPU limits, storage limits & I/O Limits
  • Any other actions or content deemed illegal in the United States or Europe.
  • Using the services to harm yourself, others, or Prism Host itself.
  • IRC/Bittorrent/P2P.
  • Purposefully Attracting DoS/DDoS Attacks.
  • Unsafe Security Practices.
If a client uses our services, network, or physical infrastructure in a manner that causes Prism Host, or any IP addresses issued by Prism Host to be “blacklisted” or “blocked”, we reserve the right to suspend and/or terminate your account and/or its services.

If you would like to report a client breaking any of our policies, you may submit an abuse report on our client portal. You have a 24 hour period to respond to an abuse report with a solution and explanation. If you fail to respond to an abuse report your service may be suspended or terminated. If you are found to break any of the above actions, we refuse to offer our Service Level Agreement to you and will blacklist you from using any of our services. Prism host is not liable for any content stored on the clients services.

Termination & Cancellation

If you wish to cancel a service for a valid reason, you must do so by submitting a cancellation request via our WHMCS client portal at https://client.prism-host.com, when a cancellation request is processed, all services associated with the cancellation request are deleted and unrecoverable. A cancellation request must be submitted when a client wishes to no longer proceed with their service. Accounts with a payment method assigned will be automatically charged for renewal for the service until the service is canceled. Payment plans 1 month or greater are contracted to that specific payment plan. We reserve the right to terminate any services related to you, and your account along with the account itself for any reason deemed necessary. Prism Host is not responsible for any termination or cancellation of your account and/or its services. We reserve all rights to terminate your service upon any violation of these terms or any other basis if deemed necessary. Services which are suspended for non-payment will be terminated 7 days after the renewal invoice is due.

Limitation of Liability and Exclusion

Prism Host, under no circumstances, shall be held liable for any data loss, disruption of information, or distribution of information including that of unauthorized access to our server systems or any other loss of data. Prism Host shall not be held liable for any disruption, delay, or disconnection of services for any period of time. We reserve the right to terminate your services and/or account in the event of a charge dispute of any kind, despite the outcome of the dispute. To the fullest extent permitted by applicable law, in no event, will Prism Host, its affiliates, officers, directors, employees, executives, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, punitive, cover, or consequential damages (including, but not limited to, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, lost of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including but not limited to, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Prism Host has been advised the possibility of such damages or could have foreseen such damages. You agree to indemnify and hold Prism Host and its affiliates, officers, directors, employees, executives, agents, harmless against any liabilities, losses, damages or cost, including reasonable attorneys’ fees incurred in connection with or arising from any third-party allegations, claims, actions, disputes, copyright infringements, any defective products sold to a client from Prism Host services. We are not directly, nor indirectly related to any third-party services we use, including but not limited to: Discord Inc., Microsoft Corporation, Alphabet Inc. WHMCS Limited, Game Panel Limited.

Unlimited/Unmetered Plans

While we offer unlimited or unmetered options such as, but not limited to: Disk, CPU, Memory. We may still put soft-caps in place to prevent abuse, if you need the cap raised, open a ticket. "Unlimited Slots" scales per the games maximum supported player count.

Affiliates & Partnerships

Prism Host offers an affiliate program which will provide you with the opportunity to receive a 10% recurring commission on referred signups. This payout is contingent upon referred signups being genuine, new sales leads. Whether or not the referred signups are genuine is solely at Prism Hosts’ discretion. We reserve the right to change the payout and/or commission percentage for any reason deemed necessary. We reserve the right to deny payout and/or commission percentages for any reason deemed necessary. Partnerships are solely up to the discretion of Prism Host. We reserve the right to terminate any partnership agreement for any reason deemed necessary.

Disclaimer

Prism Host can not guarantee that all promotional codes or discounts will work all of the time. By using any of our services, you agree to be legally bound to these terms and agreements along with any other policies. If you do not agree to our terms and/or policies, you are not authorized to use or access any of our services. We reserve the right to change, update, or otherwise modify any of our services, pricing, or agreements at any time with or without notification.
